Please read the following Terms and Conditions carefully. Upon approval of your campaign application, the Terms and Conditions become part of your Agreement with JAF, and you will be responsible for complying with them.
a. The application should be submitted at least six (6) weeks prior to the campaign. JAF will respond to your request within 5-10 business days of receipt.
b. Although JAF actively encourages athlete fundraising campaigns, all campaigns must be approved in advance. This is an important safeguard in preserving the integrity of the name and reputation of JAF, as well as our commitment to the donors.
c. JAF maintains the right to decline an athlete.
d. Athlete must seek approval from JAF to repeat the campaign each year.
2. USE OF JAF NAME, LOGO AND IMAGE:
a. JAF asserts exclusive ownership over its name, logo, and image. Any use of its name, logo, and/or image by the athlete is authorized only with prior written approval from JAF.
b. Any and all use of the JAF logo, including but not limited to all media announcements and promotional materials, must be approved by the Foundation prior to print and/or distribution.
c. JAF must be named as the beneficiary of the campaign, not the sponsor. Example of correct usage: <strong>“[Name of campaign] to benefit the Joe Andruzzi Foundation”.</strong> This applies to all invitation copy as well as advertising and promotional materials.
d. All actions for a proposed fundraiser must be approved by JAF to ensure proposal is within JAF’s guidelines and is consistent with JAF’s mission before the athlete promotes or participates in the campaign.
e. JAF’s name shall not be used to solicit professional athletes or celebrities (by phone, email, mail, through social networking, etc.) for their involvement, participation, and/or donations to your campaign. All requests of this type must clearly state that the campaign is independent from JAF. JAF hosts its own signature events and wishes to preserve its name for such events.
3. FUNDRAISING, BUDGET, PROCEEDS AND EXPENSES:
a. Athlete must submit all net proceeds raised from the campaign to JAF no later than 30 days following the conclusion of the campaign (unless otherwise approved by JAF in writing).
b. Under no circumstances may the athlete keep any portion of the net proceeds.
c. Athlete shall be responsible for all campaign expenses (i.e. participation fees, credentials, campaign promotion, apparel, etc.). JAF will not pay any expenses incurred by the athlete. All costs/expenses shall be deducted from the funds raised prior to the athlete sending a donation check to JAF.
d. JAF will not solicit donations on behalf of the athlete. However, JAF will notify its current supporters of the campaign (event date, time, and location) by listing your campaign on our supporter hosted events page.
a. JAF shall not be responsible for any financial loss suffered by the athlete and may withdraw its support for, and approval of, the athlete at any time and for any reason. This includes withdrawing use of its name, logo, and image in conjunction with the athlete at any time and for any reason.
b. Athlete must take proper precautions with regards to health insurance. JAF and its officers, directors, employees, or agents are not liable for any personal injuries suffered as a result of being a beneficiary of the campaign. Athlete shall hereby indemnify and hold harmless JAF and its directors, officers, employees, or agents for any such claim that might arise from the campaign.
c. Athlete shall be responsible to obtain all credentials required to participate in the campaign.
d. Athlete shall assume sole responsibility for participating in the campaign without involvement from JAF staff.
JAF expects all athletes to conduct themselves in a manner that reflects favorably upon JAF. For that reason, JAF reserves the right to cancel this Agreement at any time for any reason should the activities of the athlete not comply with the business standards of JAF.
a. A solicited donation is fully tax-deductible only when it is made directly and entirely to the Joe Andruzzi Foundation. This information must be stated clearly in all fundraising materials.
b. Any questions about a tax receipt guideline shall be directed to JAF.
c. Athlete shall not use JAF’s tax exemption in any manner or as part of the promotion of your campaign.
d. Athlete shall not represent to the public that the athlete is receiving any tax-exempt rights or privileges as a result of athlete fundraising for JAF (unless the athlete has separate tax-exempt status).
I have read, understand and agree to all the Terms and Conditions above hereto and incorporated herein. I understand that my campaign is not considered an approved campaign until written approval of my application is received from JAF. I agree that the Joe Andruzzi Foundation (JAF) name and logo are branded symbols, which shall not be misrepresented. Prior to publicizing or participating in the campaign, JAF must approve this application and use of its name and logo. By publicly naming JAF as the beneficiary of my campaign, I agree to donate all net proceeds (as outlined in this application) raised within 30 days following event/campaign.
I further agree that JAF, or any representative of JAF, shall not be liable for personal injuries which may occur during my campaign. I agree to indemnify and hold harmless JAF, their employees, agents, and representatives from any and every claim, demand, suit, and payment related to, or caused by, my campaign.
I understand that no amendment, modification or waiver of any of the Terms and Conditions shall be valid unless approved in writing by JAF. I acknowledge that JAF has reserved the right to cancel this Agreement at any time.
